These Rules were amended from time to time till 20 May 2003 when new Patents Rules, 2003 were brought into force by replacing the 1972 rules. Interpretation. -In this Act, unless the context otherwise requires,- (a) "adaptation" means,- (i) in relation to a dramatic work, the conversion of the work into a non-dramatic work; (ii) in relation to a literary work or an artistic work, the conversion of the work into a dramatic work by way of performance in public or otherwise; (iii) in relation to a literary or dramatic work, any abridgement of the work or any version of the work in which the story or action is conveyed wholly or mainly by means of pictures in a form suitable for reproduction in a book, or in a newspaper, magazine or similar periodical;3 (iv) in relation to a musical work, any arrangement or transcription of the work; 4  and (v) 5  in relation to any work, any use of such work involving its re-arrangement or alteration;  (b) "work of architecture" means any building or  structure having an artistic character or design, or any model for such building or structure; 6 (c) "artistic work" means- (i) a painting, a sculpture, a drawing (including a diagram, map, chart or plan), an ngraving or a photograph, whether or not any such work possesses artistic quality; (ii) work of architecture;7 and (iii) any other work of artistic craftsmanship (d) "author' means,- (i) in relation to a literary or dramatic work, the author of the work; (ii) in relation to a musical work, the composer; (iii) in relation to an artistic work other than a photograph, the artist; (iv) in relation to a photograph, the person taking the photograph; (v) in relation to a cinematograph8 or sound recording the producer; and (vi) in relation to 9 [any literary, dramatic, musical or artistic work which is computer-generated, the person who causes the work to be created;] 4. Functions of the Secretary of the Copyright Board. — The registrar of Copyrights shall perform all secretarial functions relating to the Copyright Board under the direction and control of the Chairman of the Copyright Board.

3. Except as provided in the rules the fees paid for the grant, or as the case may be, for renewal of the licence shall be non-refundable.

4. The rates of wages payable to the workmen by the contractor shall not be less than the rates prescribed for the Schedule of employment under the Minimum Wages Act, 1948, where applicable and where the rule have been fixed by agreement, settlement or award, not less than the rates fixed.

5. In case where the workmen employed by the contractor performs the same or similar kind or works as the workmen directly employed by the Principal Employer of the establishment, the wage rates, holidays, hours of work and other conditions of service of the workmen of the contractor shall be the same as applicable to the workmen directly employed by the Principal Employer of the establishment on the same or similar kind of work: provided that in the case of any disagreement with regard to the type of work the same shall be decided by the Deputy Chief Labour Commissioner(C) whose decision shall be final.

6. In other cases the wage rates, holidays, hours of work and conditions of service of the workmen of the contractor shall be such as may be specified in this behalf by the Deputy Chief Labour Commissioner(C).

7. In every establishment where 20 or more women are ordinarily employed as contract labour there shall be provided 2 rooms of reasonable dimensions for the use of their children under the age of six years. One of such rooms would be used as a playroom for the children and the other as bedroom for the children. For this purpose, the contractor shall supply adequate number of toys

and games in the playroom and sufficient number of cots and beddings in the sleeping room. The standard of construction and maintenance of the crèches may be such as may be specified in this behalf by the Deputy Chief Labour Commissioner(C)

8. The licence shall notify and change in the number of workmen or the conditions of work to the Licensing Officer.

9. A copy of the licence shall be displayed prominently at the premises where the contract work is being carried on The licence shall, within fifteen days of the commencement and completion of each contract work submit a return to the Inspector appointed under Section 28 of the Act intimating the actual date of the commencement or, as the case may be, completion of such contract work in Form VI-A
