Attention is invited to Customs Baggage Declaration Regulation, 2013 notified vide Notification No 90/2013-Cus (N.T.) dated 29.08.2013 subsequently amended vide Notification No. 133/2013-Cus. (N.T.) dated 30.12.2013 and Notification No. 10/2014-Cus (N.T.) dated 10.02.2014. The Customs Baggage Declaration Regulations, 2013 will come into force with effect from 1.03.2014. Under the Customs Baggage Declaration Regulations 2013 all incoming international passengers will be required to declare the content of their baggage in the Indian Customs Declarations Form prescribed in the regulation. Therefore the declaration relating to Customs purposes by incoming passengers in arrival card notified by MHA hitherto done by passengers will be dispensed with. In other words, the incoming passengers will have to fill up the form notified under Customs Baggage Declaration Regulations 2013 independent of the form prescribed by the MHA.  Ministry of Home Affairs has decided that arrival (disembarkation) card of MHA would be given to foreign nationals only.

Attention is invited to Notification No 12/2012- Cus dated 17.03.2012 ( Sl No 321) regarding import of gold by ‘eligible passengers’ which provides that the gold in the form of bars and ornaments are allowed to be imported by ‘eligible passengers’ upon payment of 10% customs duty. As per the specified condition no. 35 of the notification, the duty is to be paid in the foreign currency and total gold so imported should not exceed 1 kg. The notification prescribes that ‘eligible passenger’ means passenger of Indian Origin or a passenger holding valid passport issued under the Passport Act, 1967 who is coming in to India after a period of not less than 6 months of stay abroad. Short visits, if any, made by the ‘eligible passenger’ during the aforesaid period of 6 months shall be ignored if the total duration of stay does not exceed 30 days. Further, the benefit of notification is available only if the passenger has not availed of this exemption in any of such short visits.

It has come to the notice of this Ministry that some of employees of the University both in the teaching and non-teaching faculties have been filing WP in the High Courts or other Courts impeding the Visitor (President of India) as one of the respondents. 2. In this connection ij is pointed out that the Allahabad High Court, in a Civil Miscellaneous Contempt petition No.221 of 2000 delivered a judgment that the immunity enjoyed by a President of India under Article 361 (1) of the Constitution remains available to the President even in respect of functions and duties discharged as the Visitor of the University. It was further held that "no court can compel President to exercise any power or to perform any duty nor is he amenable to the writ or direction issued by any court''. A copy of the judgment is enclosed. 3. Registrars of the Central Universities and other officials dealing with court cases must ensure that this is brought to the notice of the Registrars of the Hon'ble High Courts and also apprise their Lawyers that whenever the Visitor is impeded in any court case, the order of the Allahabad High Court must be quoted invariably about the immunity enjoyed by the President of India as Visitor. The standards of these entrance examinations vary widely and the burden imposed on students in terms of time, money and the stress caused in scheduling and preparing for such examination is tremendous. The multiplicity of entrance examinations needs to be dispensed with and it then becomes incumbent to develop a nationally accepted testing mechanism. 2. The idea of developing a national testing scheme with the oversight of a National Testing Authority has been under the consideration of the Ministry of HRD for some time. Accordingly a concept paper on such a scheme was placed before the Central Advisory Board of Education (CABE), in its 61" meeing. It has been observed that a large number of companies are not filing their due documents timely with the Registrar of Companies. Due to this, the records available in the electronic registry are not updated and thereby are not available to the stakeholders for inspection. Further, due to not filing the documents on time, companies are burdened with additional fee and facing the prosecutions also.  2. There are many companies, who have also not increased their paid up capital up to the threshold limit provided in sub-section (3) and sub-section (4) of Section 3 of the Companies Act, 1956. 3. In order to give an opportunity to the defaulting companies to enable them to make their default good by filing belated documents and to become a regular compliant in future, the Ministry, in exercise of the powers under Section 611(2) and 637B (b) of the Companies Act, 1956 has decided to introduce a Scheme namely, “Company Law Settlement Scheme, 2010,” condoning the delay in filing documents with the Registrar, granting immunity from prosecution and charging additional fee of 25 percent of actual additional fee payable for filing belated documents under the Companies Act, 1956 and the rules made there under. It has been noticed that a large number of companies are approaching the Ministry for exemption under Section 212(8) of the Companies Act, 1956. The matter was examined in the context of the globalizing Indian economy, the increased number of subsidiaries, and the introduction of accounting standards on consolidated financial statements. It has been decided to grant a general exemption provided certain conditions are fulfilled.  The Central Government hereby directs that provisions of Section 212 shall not apply in relation to subsidiaries of those companies which fulfil the following conditions:- (i) The Board of Directors of the Company has by resolution given consent for not attaching the balance sheet of the subsidiary concerned; (ii) The company shall present in the annual report, the consolidated financial statements of holding company and all subsidiaries duly audited by its statutory auditors; (iii) The consolidated financial statement shall be prepared in strict compliance with applicable Accounting Standards and, where applicable, Listing Agreement as prescribed by the Security and Exchange Board of India; (iv) The company shall disclose in the consolidated balance sheet the following information in aggregate for each subsidiary including subsidiaries of subsidiaries:- (a) capital (b) reserves (c) total assets (d) total liabilities (e) details of investment (except in case of investment in the subsidiaries) (f) turnover (g) profit before taxation (h) provision for taxation (i) profit after taxation (j) proposed dividend

The Ministry has got the issue examined by Business Process Re-engineering  Group under MCA-21 and in order to speed up and simplify the process of incorporation of Companies and establishment of principal place of business in India by Foreign Companies for reduction in time taken by Registrar of Companies, the below mentioned procedure have been recommended :1. Only Form-1 shall be approved by the RoC Office. Form 18 and 32 shall be processed by the system online.2. There shall be one more category, i.e., Incorporation Forms ( Form 1A, Form 37, 39, 44 and 68) which will have the highest priority for approval. 3. Average time taken for incorporation of company should be reduced to one (1) day only. 4. A Notification to notify minor changes in e-forms 18 and 32 to enable them to be taken on record through STP mode for aforesaid procedure is being issued separately.

In supersession of all earlier circulars, it is clarified that Registrar of Companies should take extra care in examining the cases where above Directors are also identified as Officer in default. No such Directors as indicated above shall be held liable for any act of omission or commission by the company or by any officers of the company which constitute a breach or violation of any provision of the Companies Act, 1956, and which occurred without his knowledge attributable through Board process and without his consent or connivance or where he has acted diligently in the Board process. The Board process includes meeting of any committee of the Board and any information which the Director was authorised to receive as Director of the Board as per the decision of the Board.
